Hello All,
I am going to India and have to go for stamping. I come under Chennai consular district but planning to go to Delhi because of high rejection rate in Chennai.
First thing, I am not sure if I can go to Delhi when I come under Chennai consular district.
Second thing is, should there be a valid reason with supporting documents for attending the visa appointment in Delhi instead of Chennai.
Your thoughts and experiences on the above points would be very helpul for me in resolving this issue. Thanks a lot.
Why not any of the consulates in Mexico ( Juarez, nogales, el paso etc). If you have all the documents related to your employment and are able to prove you are still working and necessary for your job you should get your visa. It all depends on the documents presented and some of it on your luck

Is that normal to have the same I-94 number on my renewed H1B and my wife's H4 approval notices?
Seems it is a mistake that my old I 94 is given in H4 extension application. Do I need to apply for correction? Any Lawyer / Member, please confirm. Thanks in advance.
I-94 is what determines your legal stay in the US. Since you get an I-94 only during your entry into the US, it is normal to get the same I-94# on any subsequent extension of status applications filed within the US. Your attached I-94s on the I-797 approval notice are proof of your continuous status since your white I-94 cards might be expired. But do keep the original white I-94 cards with you as you are supposed to return them along with the new I-94s attached to I-797 notices, when you leave the country.

Do you have a good relationship with your employer. If so, if you can get your hands on the BEC letter, ie requesting your employer whether they want to continue with the processing, then it is on that letter.
The next question is should you continue with such an oppressive counsel at the next stage? Perhaps the lawyer is colluding with your employer, that would be truly difficult, since they could then just sit on the approved labour and not even file 140. You need to try and find out their intent soon.

The charges arise from the defendants� alleged scheme to coerce the labor and services of approximately 400 Thai nationals to work on U.S. farms.

Pop star Lily Allen has had her US work visa cancelled after arriving at Los Angeles International Airport.
The 22-year-old, who is due to tour America in September, had flown in for the MTV Video Music Awards launch.
A spokesman for the singer said: "She's still in America. All her commitments will carry on as normal. The work visa will be sorted out by her next visit."
She was held at the airport for five hours in connection with an arrest for an alleged assault in London in June.
The arrest arose from an incident outside a London nightclub in March and resulted in a caution for common assault.
She flew into the US from Australia on Sunday to attend Tuesday's announcement of the award nominations in Las Vegas.
An MTV spokesperson has confirmed the star will still attend the awards show.
"Lily was questioned and her work visa was revoked," Allen's spokesman said. "She was detained for five hours but not strip searched. Understandably she was upset by it."
Allen will need a new work visa before she returns to the US on 6 September, when she is due to play in San Diego.
In a statement the singer said: "I am trying everything I can to sort this out.
"It is my intention to play my American dates in September. This depends on the authorities granting me a new work visa.
"I want my fans to know that I will do everything I can to be back in America in September. I don't like letting my fans down and this is a situation that I am sure we can sort."
Allen's previous stay in the US was cut short when she postponed 20 dates from her tour in May and June because she was "bored slightly" and wanted to get back to work in the studio.

bfadlia is right ... it was/is pretty straight forward. We did it ourselves too.

The process is so simple, instructions on the website are clear. There is no need for a lawyer. Most people I know did it themselves successfully. I did it on my own too and I'm about to land soon.

I too got the soft lud's on May 21 for all of my 485. There is no change in the current status. Could that be FPs are sent or just a regular batch update? I don't know.

I am in the same boat. My 7-9 yr extn will be up in December. My PD is Dec 2005 EB2. I would like to apply for 3 yr extn of H1. I am thinking if I should just renew my EAD instead of renewing my H1. Also what would be the filing fee for H1? $320 or $320 + $1500?

Also contact your attoneys and ask them to find ways to check if your petition is present in PIMS. My attorney says there is no way he can. I also called DOS & KCC, they are not helping either.

When the dates are current then only you can add your wife name to your pending 485, until then you have to wait based upon your priority dates EB1 or EB2, during this time you should maintain your H1B status inorder to keep you wife H4 status valid.

Last i read was that the NON-RIR labors were being processed first compared to the RIR ones. So think twice before u take any decision.

Based on the numbers EB2 India should be in the range of Oct 2005 to Dec 2005 by September 2010
