If you are case is straight forward and If you are doing H-1 transfer, dont waste money on AC-21. Wait until if and when you get a RFE and respond. Do you need an example of some one who got his GC by not filing but who shifted his residence from east coast to west coast?...you are looking at his message.

I entered on a H4 on my New Zealand passport and it is valid 2010. I now have a H1B ie a I-797A and a new I-94 that is also valid till 2010. I'm leaving the country for the first time to go to Australia.
Do I need to get a new visa stamp for my passport?
If you want to enter US as an H1-B, you will need an H1-B visa stamp on your passport.
If I need to get a new visa stamp, do I need to go back to New Zealand or can I do it in other countries?
You can do that from any consulate. However, note that there is a possibility that the IO will need a so-called "security check" which takes 2-3 months (and sometimes, years). In that case, you will be stuck outside US (you cannot get back to US while the security check is pending). So it is advisable to go to a country where you have a place to stay for a long time, if needed. For most people, it is their home country. Also the chances of getting a security check is higher if you go to a consulate other than the consulate in your home country.

Hi:
If you are unmarried, then you GC parents can file an 1-130 petition for you right now. Once tthebecome a citizen, you can change the category F-1, and retain the priority date.

Interview Date - 13-Feb-2009
Purpose - H1B Visa Stamping(VISA Approval in 2008 before had F1 Visa)
Interview - VO Asked me few Questions and then asked me to show your company's Wages report and your consultacy and client where u worked agreement letter. I have given him both the docs. and Vo kept with him and gave me 221G Yellow letter which mentioned your docs. are in administrative processing and didn't mentioned any time frame.
After my Employer and i frequently sent emails and faxes to mumbai consulate but no response yet.
Anybody Knows what i have to do. Please advice me further .

Once it goes into hibernation, there is nothing much you can do. If you are a student (f1 visa), you can have your university step in for help, but it also limited.

Hello Guys,
I have been working with my current employer for last 3 years as Software engineer and filed for PERM last October (18th Oct 2007). My six year H1-B limit expires in January 2010.
Now I'm getting an opportunity to move into Technical Program Management internally (within the same company).
I have couple of questions based on the above scenario
1. Is it safe to take the new opportunity since I have to start over my PERM process (given the backlog in Atlanta center) and also given the amount of time left in my H1-B (approx 15 months left)?
2. If I file a new PERM application now, can I use the experience that I gained in this company as part of the app OR should I use only my previous employer's experience (which was 3-4 years ago and has little relation with what I might do in program management) for the PERM app?

Which state you are working in? If USCIS thinks Nebraska Service centre has the jurisdication for your I-485 based on Job location then their is nothing to worry.
Maybe your PD is current and USCIS wants to complete processing of your I-485.
I am in the same situation, my I-140 was approved from TSC about 3 months back in March 2008, and I-485 pending at NSC since august 2007. I work out of WA state.

I currently working in California and planning to move to Texas. Our company does not have a office in Texas .. so I will be working from home for the same company.
My I-140 is approved and 485 is pending for more than 180 days.
while AC-21 allows for changing employers with a different geographical location, is it OK to work for the same employer who does not have an office in a different geographical location?
Also, can we do H1B extension in this case? Any idea what my employer should show in this case if I work from home.

Yes. The key is that the entity remains the same. And same EIN is a proof for that. One company can have multiple valid DBAs at the same period of time (just like name aliases).
Still it is better to check with an attorney whether a "successor of interest" petition is needed, especially if the old DBA is invalidated.

As such, there is no grace period and it starts counting towards unauthorized stay (US is somewhat liberal for unauthorized stay for up to 180 days). It should be fine getting H1B transferred ASAP.
After 180 day, reentry can be banned for three years. After 1 years reentry can be banned for 10 years.

the only reason i'm staying here is to complete the 10 years of social security payments. leaving now would be foolish. this green card business is just a carrot to get endlessly humiliated.
does anyone have any knowledge of non-citizens claiming social security in india?
as per the SS, indian citizens who have contributed >= 10 years can claim SS payments in india.
